Probation for jilted boyfriend who hit ex-partner’s friend

First-time offender Ricardo Algarvio Pestana (20), of St Mark’s Road, pleaded guilty to attacking the man in the Millennium Town Park and David Place.

The Magistrate’s Court heard that on the day of the first assault, not only did Pestana’s girlfriend end their relationship but he also lost his job.

The court heard that the defendant had been in a four-month relationship with the woman before it ended on the evening of 3 April.

Centenier Danny Scaife said that about 7.30 pm that day the woman notified the police about an incident that took place at her home address. As a result, Pestana voluntarily attended the police station and was warned not to go to the address.

About two hours later Pestana saw his ex-girlfriend walking with two of her friends at the Millennium Town Park. He went over to the group but his former partner did not want to speak to him. Her friends, who included the victim, tried to get him away and asked him to leave.

Pestana then punched the male victim, but the man escaped without injury.

The defendant was arrested, released by police and warned to attend a parish hall inquiry.

However, about 12.35 am on Sunday 8 April, the victim from the first assault was walking along David Place when he was pushed strongly from behind and fell onto his knees.

When he got up, he turned and saw Pestana, who then allegedly said to the victim: ‘Now you have no one to protect you.’

The victim thought Pestana wanted a fight and he ran off. He called the police while he was running away.

Advocate Sarah Dale, defending, said that her client felt deep shame and remorse.

‘Not only had his girlfriend wanted to end his relationship that day but he had also lost his job. He really was not himself,’ she said. She said that he wished to apologise to both his ex-girlfriend and the victim.

Magistrate Bridget Shaw said that the assaults appeared to have arisen because the defendant was unable to control his emotions.

‘It is very important to respect your ex-girlfriend’s decision and you must not take your frustration out on someone else.

‘It is not for you to determine who she spends time with,’ she said.

Pestana was sentenced to six months’ probation and fined £300.
