The Economic Development Committee have been served with a notice under the Planning Law to remove the composting operations and sort out any pollution or contamination that has been caused.The arsenic poisoning at the site first came to light towards the end of last year, and a serious contamination of groundwater occurred.

About 4,000 tonnes of contaminated wood chippings and around 6,000 tonnes of soil conditioner will have to be taken away from the site within 12 months.The police have conducted extensive investigations and have passed a file to the Law Officers’ Department, who will decide whether to press charges against Economic Development.

If they were prosecuted under the Water Pollution (Jersey) Law for polluting controlled waters, they could face an unlimited fine.
