Prior to the comments of the judge, the States and Crown side had maintained that the Les Pas claim had no merit.Senator Walker said that Howard Page, QC, who will try the case if it goes to court, had said that although he could not comment on the merits of either party’s case, ‘it appears to me that there is a serious issue to be tried’.Mr Page made the comments in a preliminary judgment delivered in July last year at the end of an application made by the States side for security for costs.
