Four accused in affray case narrowly escape prison sentence

The court watched video footage of the incident, which took place outside British Home Stores one evening in July as onlookers were passing by.Karl Harben (23), who admitted the affray charge and also committing a grave and criminal assault, was sentenced to 180 hours of community service.Co-accused Rebekah Andrews (23), who also admitted the same charges, was sentenced to 150 hours of community service.Brothers Joao Ascencao (28) and José Ascencao, who admitted causing an affray, were each given 120 hours of community service.Due to alcohol being a factor in the offence, all four were banned from entering pubs, nightclubs and restaurants for six months.Deputy Bailiff Michael Birt said the court had warned before that those committing an affray by fighting in the street were likely to go to prison.However, after very careful consideration the court accepted that this incident could be regarded at the lower end of the scale and had taken into account mitigation in relation to the accused, three of whom had no previous record of violence.
