Tearoom worker in ‘drink-fuelled’ attack

The Magistrate’s Court heard that Pawel Krzysztof Podstawa, of La Vallée de Rozel, St Martin, punched his victim’s head and body more than 20 times as well as kicking and kneeing him.

The 28-year-old has been warned he may face a custodial sentence for what was described by Assistant Magistrate Peter Harris as a ‘serious assault’.

The ‘drink-fuelled’ attack took place at about 7 pm on Thursday 14 September after the pair had watched the Jersey International Air Display.

Legal adviser Laura Hallam said the attack took place in broad daylight and happened in two sections.

In the first part of the incident, Podstawa punched the victim’s head and body more than 20 times before the pair were separated by members of the public.

The second attack involved more punches as well as multiple kicks to the upper body but not to the head.

Assistant Magistrate Peter Harris said the injuries were not serious and a police medical examiner described them as ‘grazing and bruising’.

Miss Hallam had earlier proposed that the case be committed to the Royal Court but Mr Harris said: ‘While acknowledging it was a sustained attack, I think that on balance, it stays just within this court’s jurisdiction.’

Mr Harris added that the incident appeared to have been unprovoked ‘but probably results from too much alcohol’.

The court heard that the victim, who is a friend and colleague of the defendant who works at Rozel Bay Tea Rooms, did not want to make a complaint about the charges.

As part of Podstawa’s bail conditions, Mr Harris imposed a ban on the defendant leaving the Island and also barred him from licensed premises.

In adjourning the case until 24 October, he said: ‘I am going to ask the Probation department to prepare a background report.’
