Victoria Avenue drink-driver is jailed

Ben Davies (36) appeared before Relief Magistrate David Le Cornu this week for sentencing after admitting drink-driving and driving without a licence or insurance.

Davies, who had only been in Jersey a short time, was seen driving erratically on Victoria Avenue on 28 September.

After Davies returned home, police arrived minutes later and he was breathalysed and found to be over the drink-drive limit, providing a reading of 89mg of alcohol per 100 millilitres of breath. The legal limit is 35mg.

Advocate Alison Brown, defending, said Davies ‘completely accepts responsibility for his actions’.

She added that the defendant had consented to leave the Island, should that be deemed appropriate.

However, Mr Le Cornu sentenced Davies to four months in La Moye prison, noting the serious nature of the drink-driving charge and his previous convictions for driving while under the influence of alcohol or drugs in the UK.

Davies was also sentenced to two months’ imprisonment on the charge of driving without insurance, which is to run concurrently with the drink-driving sentence.

No separate penalty was given on the charge of driving without a licence. Davies was also disqualified from driving for two years.
